All orders accepted by AfriLaser trading as AcmeAfrica are subject to the Terms and Conditions of Sale set out below. No other terms will apply to the supply of products and services AfriLaser trading as AcmeAfrica n unless agreed in writing by an authorised signatory or expressly stated otherwise in these terms and conditions of sale. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. The courts of South Africa shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms and Conditions, provided that AfriLaser trading as AcmeAfrica reserves the right, at its sole discretion, to initiate and pursue legal proceedings in any other jurisdiction it deems appropriate. Customers who are Consumers may submit any disputes with AfriLaser trading as AcmeAfrica for resolution to the relevant industry Ombudsman or such other forum as specified in applicable laws. If any part of these terms and conditions of sale is found to be unenforceable by any court or competent authority or would be found to be unenforceable if it were interpreted or construed in a particular way, then it is the parties' express intention that the relevant wording should be interpreted or construed so as to avoid such a finding and that, in the event of such a finding, the remainder of the provision in question shall be interpreted or construed to give it full effect.

1.1 AfriLaser trading as AcmeAfrica (hereinafter “AcmeAfrica”) is not an authorized distributor, agent, or representative of any of the brands, manufacturers, or trademark holders referenced or featured on this website. 8. Consumer Protection Act Compliance
8.1 Nothing in these Terms and Conditions of Sale shall be interpreted or applied so as to:
i) exclude or limit the liability of AcmeAfrica (including liability for loss directly or indirectly attributable to the gross negligence of AcmeAfrica, its employees, agents, or representatives), where such limitation or exclusion is prohibited by applicable law;
ii) require the Customer to assume any risk or liability which, under applicable law, cannot be lawfully imposed upon the Customer; or
iii) limit or exclude any statutory warranties, representations, or obligations which are implied by, or imposed under, applicable law, including without limitation the Consumer Protection Act, 68 of 2008, as amended (“CPA”), to the extent that such limitation or exclusion would be contrary to the provisions of such law.
8.2 If any provision of these Terms and Conditions of Sale or any agreement, transaction, or service arising therefrom is governed by the CPA, it is not intended that any such provision contravenes any section of the CPA. Accordingly, all terms herein shall be deemed to be qualified and interpreted to the extent necessary to ensure full compliance with the CPA.
9. Force Majeure
9.1 For the purposes of this Agreement, a "Force Majeure Event" shall mean any circumstance or event beyond the reasonable control of AcmeAfrica, including but not limited to acts of God, war, terrorism, civil unrest, strikes, lockouts or other industrial disputes (whether involving Reitz Automation’s workforce or that of a third party), fire, flood, epidemic, pandemic, adverse weather conditions, acts or omissions of government, traffic congestion, transport delays, failure or breakdown of plant, machinery, or communication systems, or the inability to obtain services, materials, or articles required for the performance of the contract except at increased cost.
9.2 In the event that AcmeAfrica is prevented from or delayed in performing any of its obligations under these Terms and Conditions as a result of a Force Majeure Event, AcmeAfrica shall be relieved of its obligations for the duration of such Force Majeure Event and shall not be liable for any delay or failure in the performance of any such obligations during the continuation of the Force Majeure Event.
9.3 If a Force Majeure Event continues for a period of more than fourteen (14) consecutive days, AcmeAfrica shall be entitled, in its sole discretion and without any liability, to cancel the affected order(s) or to terminate these Terms and Conditions, in whole or in part, by written notice to the Customer.
10. Pricing and Payment Terms
10.1 The indicative prices of products and services are as displayed on the AcmeAfrica website. AcmeAfrica reserves the right to modify prices at any time without prior notice. The final price for any product or service will be confirmed in writing by AcmeAfrica at the time of order acceptance and will include any applicable discounts and shipping charges.
10.2 For forward orders—products or services scheduled for delivery at a future date—AcmeAfrica reserves the right to adjust pricing after order acceptance by providing written notice to the Customer.
10.3 All prices listed on the website are exclusive of value-added tax (VAT) and any other applicable local sales taxes, which will be added at the prevailing rate at the time of order confirmation. All transactions shall be conducted in South African Rand (ZAR).
10.4 All product prices listed are inclusive of delivery or shipping charges from the port in Durban, KwaZulu Natal to the customer's/your stipulated physical address. Delivery charges will be quoted via the online checkout system. Further shipping charges for the international route of the goods are quoted for and charged separately, and shall be confirmed in writing at the time of order acceptance.
10.5 AcmeAfrica conducts business solely within the borders of the Republic of South Africa. We do not offer sales, deliveries, or services outside South Africa. Any orders placed for delivery beyond South African borders will not be accepted or fulfilled.
10.6 Ownership of any goods shall remain with AcmeAfrica until full payment has been received. If payment is not received, or if the payment method is declined, ownership of the goods will not transfer to the Customer, and the goods will not be shipped.
11. Offer and Acceptance
11.1 A binding contract between AcmeAfrica and the Customer will only be formed upon written confirmation by AcmeAfrica of the pricing and delivery terms relating to the Customer’s order.
11.2 Each confirmed order shall constitute a separate and independent agreement between AcmeAfrica and the Customer, governed exclusively by these Terms and Conditions.
12. Order processing
12.1 AcmeAfrica reserves the right, to the fullest extent permitted by applicable law, to refuse to engage in trade with any individual or entity at its sole discretion. AcmeAfrica may decline to accept any order, regardless of whether payment has been received, by providing the Customer with notice of non-acceptance via telephone or email within a reasonable time after receipt of the order.
12.2 AcmeAfrica reserves the right to vary or cancel any accepted order prior to the collection or delivery of goods by providing written notice of such variation or cancellation to the Customer via telephone or email within a reasonable period. In such cases, AcmeAfrica shall not be liable for any penalty or damages. If an order is rejected or cancelled after payment has been made, the full amount paid will be refunded to the Customer as soon as reasonably practicable.
12.3 Orders are accepted only from companies or individuals registered in the Republic of South Africa. Order processing will commence only upon receipt of a confirmed order and full payment. In the case of electronic funds transfers (EFTs), processing will begin only once the funds have fully cleared into AcmeAfrica designated bank account, typically within two to three business days.
12.4 AcmeAfrica does not offer export services and does not ship goods outside of South Africa.
13. Delivery
13.1 Subject to any cancellation, substitution, or non-fulfilment of the Customer’s order in accordance with the clause 12 (Order Processing), AcmeAfrica shall deliver the products specified in the confirmed order. AcmeAfrica reserves the right to use third-party delivery agents to fulfil its delivery obligations. All orders placed on Fridays will be processed the following business day. Public holidays will also be taken into effect and orders will be finalized thereafter.
13.2 Available delivery options and applicable charges will be specified in the official quotation provided to the Customer, and such charges will apply as of the date of order placement or as otherwise communicated at the time of order. Delivery charges are applied per order, regardless of the quantity of products included.
13.3 Unless otherwise agreed in writing, delivery shall be made to the Customer’s standard business address as provided at the time of order. Title to and risk in the goods shall pass to the Customer once the order has been dispatched from AcmeAfrica premises or 3rd party elected premises at the port/s. AcmeAfrica assumes no responsibility for orders delayed, lost, or misdelivered due to incorrect or incomplete shipping information provided by the Customer.
13.4 Any delivery times quoted are estimates only. To the fullest extent permitted by law, AcmeAfrica shall not be held liable for any direct or indirect loss or damage resulting from delivery delays. Time shall not be of the essence in respect of delivery obligations.
13.5 In the event that a package is returned to AcmeAfrica as undeliverable, reasonable efforts will be made to contact the Customer to arrange for re-shipment.
13.6 If the Customer does not collect the Products or give AcmeAfrica adequate instructions regarding transportation of the Products from AcmeAfrica premises, then AcmeAfrica may, without prejudice to any of its other rights or remedies:
i.) arrange transportation of the Products to the Customer’s domicilium citandi et executandi by whatever means it thinks most appropriate at the Customer's risk and expense; or
ii.) arrange storage of the Products at the Customer's risk and expense; or
iii.) notice in writing, treat the agreement between the parties as repudiated by the Customer.
14. Inspection, Transit Delays and Non-delivery
14.1 The Customer is required to inspect all products as soon as reasonably practicable following delivery or collection. The Customer must notify AcmeAfrica in writing within seven (7) days of the date of delivery or collection, or in the case of clause (iv), within seven (7) days of the estimated dispatch date, in relation to any of the following:
i. Visible Defects: Any defect that is apparent upon reasonable examination of the products. In such cases,AcmeAfrica may, at its sole discretion, either replace the affected products or refund the purchase price. Products delivered in a visibly damaged condition must be refused at the time of delivery.
ii. Short Delivery: Any shortfall in the quantity of products delivered. AcmeAfrica may, at its sole discretion, deliver the missing products or refund the value of the undelivered items.
iii. Incorrect Products: Any products delivered that do not conform to the Customer’s order. AcmeAfrica may, at its sole discretion, replace the incorrect products or refund the purchase price.
iv. Non-Delivery: Any non-delivery of products. In such cases, notice must be given within seven (7) days of the dispatch date. AcmeAfrica may, at its sole discretion, deliver the undelivered products or refund their purchase price. Every effort is made to get your order on time, however unforeseen events may cause delays, i.e courier companies having logistical problems. Should we be faced with such an occurrence AcmeAfrica will contact you directly with a revised delivery schedule.
14.2 If the Customer fails to notify AcmeAfrica within the timeframes specified above, the products shall be deemed to have been accepted in good order, free from any visible defects or discrepancies, and in full conformity with the order. AcmeAfrica dispatch records, including those relating to quantity, shall constitute conclusive proof of delivery, unless the Customer can provide evidence to the contrary.
15. Risk and Ownership
15.1 Where products are to be delivered to the Customer’s usual business address, the risk of loss or damage shall pass to the Customer upon delivery. If the Customer fails or refuses to take delivery when attempted by AcmeAfrica or its delivery agent, risk shall pass at the point of attempted delivery.
15.2 In cases where the Customer elects to collect the products from a designated AcmeAfrica collection point or trade counter, the risk of loss or damage shall transfer to the Customer at the time of collection.
16. Warranties and Remedies
16.1 AcmeAfrica warrants that all products sold are free from material defects at the time of delivery. In the event that a product is found to be materially defective, and subject to the provisions outlined in Clause 14 (Inspection, Transit Delays and Non-delivery ), AcmeAfrica shall, return the product to the supplier, and it shall be at the suppliers sole discretion, to repair or replace the defective product, or issue a refund of the purchase price. No immediate replacement shall be offered, while waiting on a response from the supplier. Note that we also utilize overseas suppliers, so a response may take up to 10 days.
16.2 These warranties shall not apply to defects arising from improper use, failure to follow the manufacturer's instructions, or unauthorised repair or modification of the product. The Customer acknowledges and agrees that it bears sole responsibility for ensuring that the products and/or services ordered are suitable and fit for the Customer’s intended use or purpose.
16.3 AcmeAfrica reserves the right to reject any returns that do not comply with the conditions set forth in this Clause. Any such rejected items may be returned to the Customer at the Customer’s expense.
16.4 Any products replaced under warranty shall become the property of AcmeAfrica. Title to replacement products shall pass to the Customer in accordance with Clause (Risk and Ownership), and the warranty period for replacement products shall be limited to the remainder of the original warranty period.
16.5 Except as expressly provided in these Terms and Conditions, all other warranties, terms, and conditions (whether express, implied, statutory, or otherwise), including but not limited to implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and the provision of services with reasonable care and skill, are hereby excluded to the fullest extent permitted by law.
16.6 The Customer acknowledges and agrees that it bears sole responsibility for ensuring that the products and/or services ordered are suitable and fit for the Customer’s intended use or purpose.
17. Order Cancellation and Product Returns
17.1 AcmeAfrica may, at its sole discretion and subject to written confirmation, permit the cancellation of an order in circumstances where no defect exists in the product. Such cancellations may be subject to reimbursement by the Customer of any costs incurred by AcmeAfrica as a result of the cancellation, including but not limited to a reasonable processing and handling charge.
17.2 In the event that only a portion of an order is cancelled, AcmeAfrica reserves the right to adjust the pricing on the remaining items delivered, including the withdrawal of any volume discounts previously applied, and to invoice the Customer accordingly.
17.3 For Customers who are not classified as Consumers under applicable law, a processing fee may be charged for returns that are not due to a product defect covered under Clause 16 (Warranties and remedies).
17.4 Products may only be returned to AcmeAfrica and considered for a credit, refund, or replacement under the following conditions:
i) The Customer must first obtain a Return Authorization Number ("RAN") from AcmeAfrica, which must be quoted on all accompanying documentation.
ii) Returns must be initiated within thirty (30) days from the date of delivery or collection, as stated in the delivery documentation.
iii) Products must be returned in their original, unopened packaging and in a condition suitable for immediate resale.
iv) The Customer must comply with any return-related instructions specified by Reitz on its website or other official communication.
v) Returned items must be securely packaged and shipped pre-paid to the AcmeAfrica current physical address.
vi) The RAN must be clearly marked on the outside of the return package.
17.5 If a product is returned without full compliance with Clauses 12.4 (i)–(vi), AcmeAfrica reserves the right to reject the return, return the product at the Customer’s expense, or charge a handling fee representing the actual costs of processing the return.
17.6 The "no-fault" return policy expressly excludes the following categories of products:
17.7 AcmeAfrica assumes no responsibility or liability for any damage or loss of returned products while in transit from the Customer to AcmeAfrica, unless the return shipping is arranged and managed directly by AcmeAfrica.
18. Limitation of Liability
18.1 To the fullest extent permitted by law, AcmeAfrica shall not be liable to the Customer—whether in contract, delict (including negligence), breach of statutory duty, or otherwise—for any of the following types of loss or damage, howsoever arising:
a) indirect, incidental, or consequential loss or damage;
b) loss of revenue;
c) loss of profits or anticipated profits;
d) loss of productivity or operational time;
e) loss of production;
f) loss of business, contracts, or anticipated business;
g) economic loss of any kind; or
h) loss of reputation or damage to goodwill.
18.2 Notwithstanding any other provision in these Terms and Conditions, the maximum aggregate liability of AcmeAfrica to the Customer in connection with any claim arising out of or in relation to any order, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, shall be limited to the total price paid by the Customer for the order giving rise to the claim.
